Sued for Money in San Diego Superior Court
Sued in California Superior Court over a credit card or other money debt?
Want a lawyer to represent you or help doing it yourself?
Victim of identity theft and creditor still insists you are liable?
Don't default on any lawsuit by failing to file a proper and timely response on court approved forms or pleadings drafted for your case, or you waive your rights. A letter to the court will not be filed and will NEVER protect your rights. Don't count on debt consolidation firms to file a response for you. Check your agreement. They usually are not lawyers, say so, and exclude handling any kind of on-going lawsuit. Find a licensed attorney to address your needs when sued in a court of law.
Even if you must pay, it is often possible to set up a repayment plan that stops the interest and avoids having a judgment on your credit report for 10 years. It is also possible to get a discounted settlement if you can make a one-time payment.
If you are the victim of identity theft, it is possible to file a cross-claim against the Plaintiff under California Civil Code §§1798.92 et seq. You may not owe anything.
You may have any number of defenses to the lawsuit or the debt collector may not have the evidence to make their case. Usually consumers are at a loss to deal with the collector or the court. Find out. Attorney rates tailored to the amount demanded.
A number of options are available. If you prefer to represent yourself, Attorney Doukas can prepare documents for you (Limitrf Civil only), advise you, make special appearances for you, or even defend you at trial, for a fee tailored to your need, on a task-by-task basis. Or, Attorney Doukas can be your attorney of record through settlement or trial and judgment.
